INTRODUCTION

Welcome and thank you for using the BSG Energade Triathlon Series official website (the “Website”). The Website is owned by Tigerbrands (the "Owner”) and is hosted and managed in the Republic of South Africa.

Entries made on the site are subject to the terms and conditions of this Agreement, to the exclusion of all other terms.

Online entry and/or use of the Website constitutes acceptance of these terms and conditions.

The Owner reserves the right to amend these terms and conditions from time to time. Any such amendments will take effect immediately upon posting of the amended terms and conditions on the Website.

To enter on the Website you must be the holder of a valid credit card, signature based debit card, or other form of electronic payment accepted by this site ("Payment Card").

ONLINE ENTRIES

To enter online you will be required to provide certain information including personal details, etc. The Owner will only use the personal information in accordance with the privacy policy contained herein.

PRIVACY POLICY

Your privacy is very important to the Owner and therefore any information you provide to us is treated as confidential and therefore stored on a secure server.

We are committed to safeguarding the privacy of our users whilst providing a personalised and valuable service.

We may choose to collect personal information from you via the Website through the use of enquiry and registration forms, and every time you e-mail us your details.

We may also collect information automatically about your visit to the Website.

We do not sell or rent personal information about entrants to third parties. The Owner does however reserve the right to disclose aggregated information (so that no individual user is identified) regarding the entrants and usage of the Online Entry Process (such as member demographics and traffic patterns) to, amongst others, our associated companies such as Tigerbrands (the event’s sponsors). We may also disclose your personal information to third parties where:

• We are compelled by law or a court order to do so, or if we believe that such action is necessary for the purposes of the legitimate interests pursued by the Owner, to protect and defend its rights, property or safety, the Website, visitors to the Website or others;
• We may use third parties to provide us with services. For example, we may use a third party to distribute our publications. If you have told us that you wish to receive a publication, that third party would need your mailing address. They would only be allowed to use your mailing address for the purpose of sending you the relevant publication; or
• The disclosure is made with your consent.

SECURITY POLICY

The Website uses industry standard Secure Socket Layer (SSL) encryption technology to protect your personal information or credit card details as they are transmitted over the Internet.

SAFE CREDIT CARD AND TRANSACTIONS

Any payment that you make through the Website is managed by a secure internet transaction processing service provided by Virtual Card Services. As you complete your payment, you'll be asked for your credit card number, credit card type, expiry date, CVV2 number, name on credit card and e-mail address.

Virtual Card Devices uses 128 bit Secure Sockets Layer (SSL) software, which encrypts information inputted. Their servers are certified by Thawte, a public Certificate Authority, ensuring you and the merchant that nobody can impersonate VCS to obtain confidential information.

Thawte store information gathered on secure computers. The number of employees involved in the management of the data center that have physical access to these computers is limited. Firewalls and other security technology are used to prevent their computers from being accessed by unauthorised persons and against disclosure, alteration or destruction. The merchant is never permitted access to the cardholder’s card details.

PAYMENT

Virtual Card Services shall be authorised to debit the aggregate amount payable for the entry against the authorised Payment Card supplied by you when completing the online payment process.

You must supply your Payment Card number and details with each entry, as these are not stored anywhere for security reasons. Super Event’s secure server encrypts your Payment Card details so as to minimise the risk of unauthorised disclosure or interception. See our Security Policy for more information.

By entering online you warrant that you are authorised to make payment with the card and that there are sufficient funds available to pay the entry fee.

REFUND POLICY

Once completing an entry and making payment, no refunds will be processed.

INTELLECTUAL PROPERTY

The Owner retains all copyright to all material, including logos and other graphics which form part of the website.

All data and information communicated to or from the Website and/or any site information and database remain and shall be the sole property of the Owner.

The Owner grants you permission to view, electronically copy and print in hard copy forms from the Website for the sole purpose of interacting with the BSG/Energade Triathlon Series organisers. These are for your personal use only.

Any other use of materials on the Website, including a reproduction for purposes other than those noted above, modification, distribution or reproduction, without the prior written consent of the Owner and the lawful trademark and/or copyright owner (if applicable) is strictly prohibited and constitutes an unlawful infringement of the intellectual property rights of the Owner and/or such trademark and/or copyright owner.

DISCLAIMERS AND EXCLUSIONS OF LIABILITY

You expressly agree that use of the Website or the internet is entirely at your own risk. The Website and its contents are provided on an "as is" and "as available" basis. The Owner and Cycle Events make no representations or warranties of any kind, whether express or implied including, without limitation with respect to the website, its contents, the accuracy thereof, or any warranties or representations regarding the effectiveness of any security or encryption facilities or with regard to the availability of products and/or delivery arrangements and times.

The Owner and Cycle Events disclaim all representations and warranties, including but not limited to warranties as to their availability, accuracy or content of information, products or services, and warranties of or fitness for a particular purpose of information or services.

The Owner and Cycle Events do not warrant that the functions provided by the Website will be uninterrupted or error free, or that the Website or the server which makes it available are free from viruses or other harmful components.

Unless expressly set out herein, The Owner and Cycle Events shall under no circumstances what so ever be liable to you, including without limitation, as a result of or in connection with their negligent (including grossly negligent) acts or omissions or those of their employees, agents or designees or other persons for whom in law they may be liable (in whose favour this constitutes a contract or undertaking for their benefit), for any direct, indirect, incidental, special or consequential loss or damage of any kind whatsoever or howsoever caused (whether arising under contract, delict or otherwise and whether the loss was actually foreseen or reasonably foreseeable), sustained by you, as the participant in the BSG/Energade Triathlon Series events.

The Owner and Cycle Events, their directors, employers, designees, agents, representatives, affiliates and suppliers shall not be liable for any loss, damage (whether direct, indirect or consequential) or expense of any nature whatsoever which may be suffered as a result of, or which may be attributable, directly or indirectly, to the use of or reliance upon the Website (including any information contained thereon) or the internet. You will indemnify us and keep us fully indemnified from and against any loss or damage suffered or liability incurred, including without limitation in respect of any claim or demand by any third party by reason of any act or omission on your part or that of any family member, agent or representative acting on your behalf in connection with transactions concluded on the Website, and/or in terms of these terms and conditions. Not withstanding any other provisions contained herein, BSG/Energade Triathlon Series’ liability whether in contract or delict arising from any breach of any obligation in terms of these terms and conditions, negligence or otherwise shall not exceed at any time more than double the monetary value of the order in respect of which any such dispute or claim arises.

GENERAL TERMS

The content presented on the Website may be used by you for your own personal, and information purposes only. In using the website you agree not to infect it with any computer programming (such as a virus) that may damage, interfere with, delay or intercept any data or information on the Website. You shall indemnify The Owner and Cycle Events against any damage caused by any such act attributable to you.

The Owner may suspend the Website or any part thereof or terminate your account at any time if the Owner should determine that the Website is not being used by you in compliance with these terms and conditions. These terms and conditions constitute the whole agreement between the parties relating to the subject matter hereof. Any indulgence in extension of time granted by us to you shall not be construed as a waiver or variation of any of our rights or remedies.

At the option of the Owner, any dispute arising out of these terms and conditions may be brought before any Magistrates' Court of competent jurisdiction notwithstanding that the amount in issue may exceed the jurisdiction of such court. These terms and conditions are governed by the laws of the Republic of South Africa.
